The regulation of products in the European Union

 

E-cigarettes are regulated under the EU Tobacco Products Directive, which is currently being evaluated by the EU Commission.

 

In April 2014, the European Union (EU) adopted the EU Tobacco Products Directive (TPD).

 

Since 20 May 2016, the TPD has been in force in EU member states with the aim of optimizing the internal market for tobacco and related products, while ensuring the health and well-being of European citizens. The TPD aims to strictly regulate the manufacture, presentation and sale of these products throughout the EU.

 

Last but not least, Article 20 of the TPD is dedicated to electronic cigarettes (e-cigarettes) and imposes a strict set of guidelines. These guidelines include the setting of a maximum nicotine level, mandatory packaging and labeling rules, and requirements for continuous monitoring and reporting of all developments related to e-cigarettes.

 

In 2021, the TPD is subject to a much-anticipated review. This review should make a comprehensive assessment of the clear differences between tobacco and vapor products.

 

In addition to the legislation, the following clauses are also included:

 

  • Clauses to ensure that smokers receive accurate risk-based information about the differences between vaping and smoking tobacco.

 

  • Strong focus on preventing youth use, working with manufacturers and retailers to combat underage use and sale.

 

  • Strong standards for manufacturing, product quality and safety.
